Q: What if the other driver asserts that I’m partially responsible for the accident?
Nevada is not a state where if you are partially responsible you don’t get anything.
If you are 51% or more at fault, you get nothing. But, if you are found to be 10% at fault, the amount of recovery is reduced by the amount at fault. In that example of 10% responsibility, if the damages are determined to be $20,000, they would reduce the damages by 10% of that ($2,000) and be left with $18,000.
