In the instance of the Special Master who is reviewing damages before the settlement or judgment, a claimant can have some input about the damages for themselves.
In the course of a large class action lawsuit we recently settled, the court appointed a Special Master to calculate the amount of damages. The Special Master came up with questions for the 580 class members to help him determine the amount of damages. These questionnaires were sent to each class member to fill out and provide supporting documentation.
From that feedback as well as some back and forth between the class member and the Special Master, the court had the information it needed to decide the amount of damages.
