Leverty & Associates Law Chtd. has experience with insurance bad faith. When one needs insurance protection, they do not need the shock and distress of having their claim denied or their policy cancelled. One purchases insurance to provide peace of mind when catastrophes happen. Policyholders understandably feel distressed when that peace of mind is unfairly yanked by an insurance company.
An insurance policy is a contract between the policyholder and the insurance company. In exchange for the insured’s payment of premiums, the insurance company agrees to provide peace of mind by:
Providing the coverage provided in the policy;
Acting fairly and in good faith toward its policyholders; and
Considering the policyholders’ interests at least equal to its own interests.
An insurance company acts in bad faith when it, without good reason, unfairly delays payment of a claim, underpays a claim, fails to properly investigate a claim, denies payment of claim, or cancels a policy. When an insurance company acts in bad faith it deprives an insured of his/her peace of mind. For that reason, Nevada courts recognize that the tort of insurance bad faith goes beyond a mere economic offense.
Leverty & Associates Law Chtd. represents individuals and businesses in bad faith litigation. We seek compensation for our clients’ financial losses and loss of peace of mind, regardless of the type of insurance policy (liability, homeowners, commercial, automobile, life, health, disability). When appropriate, we also seek punitive damages and attorney’s fees for our clients.
Not every denied claim amounts to insurance bad faith. Insurance bad faith lawsuits are involved. Insurance laws and regulations are complex. It takes an experienced bad faith law firm with the resources and special knowledge of insurance laws, regulations and insurance claim practices to evaluate the claim denial and determine whether the insurance company’s actions might amount to bad faith. Leverty & Associates Law Chtd. has the unique resources and background to properly evaluate the insurance company’s actions.

Group health insurance generally means your legal rights against the insurance company and/or employer who self-insures its employees’ health coverage are governed by a federal law called the Employment Retirement Income Securities Act (“ERISA”).
The courts have determined that under ERISA, your legal rights against the insurer or self-insured employer are restricted and you are required to appeal the denial of your claim to the insurer or self-insured employer.
One must follow the strict appeal rules set forth in your insurance policy or insurance plan and it is highly recommended that everyone obtains legal advice during the appeal process because usually only the appeal record can and will be considered by the court. Since the appeal is required before one can bring a legal action for the failure to provide health coverage, it is extremely important and in fact “critical” that one obtains an attorney during the initial appeal process.
If the appeal record is inadequate then not only may it be difficult to find an attorney to take your legal matter, but it is unlikely that a lawsuit would result in getting your claim paid. Your legal rights are restricted such that even a successful lawsuit would only result in your receiving your denied benefits, with interest thereon and possibly reimbursement of attorney fees and costs.
If your health insurer denied your claim, it is important you immediately seek an attorney to assist you so that you do everything correctly to protect your appeal and legal rights.
